Bu noktada ev sahipleri ve kirac\u0131lar\u0131n g\u00fcncel yasalardan habersiz olmalar\u0131, \u00e7e\u015fitli sorunlarla kar\u015f\u0131la\u015fmalar\u0131na yol a\u00e7ar. Taraflar\u0131n kira art\u0131\u015f s\u0131n\u0131r\u0131, tahliye sebepleri ve depozito kurallar\u0131 gibi kira hukukunun yap\u0131 ta\u015flar\u0131n\u0131 bilmemeleri, \u00e7e\u015fitli anla\u015fmazl\u0131klar do\u011furur. Bu \u00e7er\u00e7evede i\u00e7eri\u011fimizde kirac\u0131 haklar\u0131 2026 dinamikleri hususunda bilinmesi gerekenleri payla\u015faca\u011f\u0131z.<\/p>\n<h2>Kirac\u0131 Haklar\u0131n\u0131n Yasal Dayana\u011f\u0131 Nedir?<\/h2>\n<p>Kirac\u0131 haklar\u0131, 6098 say\u0131l\u0131 T\u00fcrk Bor\u00e7lar Kanunu\u2019nda d\u00fczenlenmi\u015ftir. TBK 299. ila 378. maddeleri aras\u0131 kirac\u0131lar\u0131n haklar\u0131na dair d\u00fczenlemeleri i\u00e7erir. S\u00f6z konusu kanunda yer alan ba\u015fl\u0131ca noktalar a\u015fa\u011f\u0131daki gibidir:<\/p>\n<ul>\n<li>Y\u0131ll\u0131k kira art\u0131\u015f s\u0131n\u0131r\u0131<\/li>\n<li>Kirac\u0131n\u0131n hangi durumlarda tahliye edilece\u011fi<\/li>\n<li>Ev sahibinin ay\u0131ptan sorumlulu\u011fu<\/li>\n<li>Kirac\u0131n\u0131n kiraya verilen m\u00fclk\u00fc \u00f6zenle kullanmas\u0131 gerekti\u011fi<\/li>\n<li>Alt kira yasa\u011f\u0131<\/li>\n<li>G\u00fcvence bedeli (Depozito) s\u0131n\u0131r\u0131<\/li>\n<\/ul>\n<p>TBK\u2019de kirac\u0131n\u0131n \u00f6deme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcne dair maddeler de vard\u0131r.<\/p>\n<h2>2026 Y\u0131l\u0131nda Yasal Kira Art\u0131\u015f S\u0131n\u0131r\u0131 Nedir?<\/h2>\n<p>Ge\u00e7mi\u015fte bir d\u00f6nem y\u0131ll\u0131k kira art\u0131\u015f oran\u0131 %25 olarak belirlenmi\u015ftir. Fakat 1 Temmuz 2024 tarihinde yasal kira art\u0131\u015f s\u0131n\u0131r\u0131 12 ayl\u0131k T\u00dcFE oran\u0131 olacak \u015fekilde belirlenmi\u015ftir. 2026 y\u0131l\u0131nda yasal kira art\u0131\u015f s\u0131n\u0131r\u0131, 12 ayl\u0131k T\u00fcketici Fiyat Endeksi ortalamas\u0131d\u0131r. Ev sahiplerinin kiraya, T\u00dc\u0130K taraf\u0131ndan belirlenen T\u00dcFE oran\u0131n\u0131n \u00fczerinde zam yapmas\u0131 yasakt\u0131r. \u00d6rne\u011fin 2026 y\u0131l\u0131n\u0131n Mart ay\u0131nda 12 ayl\u0131k T\u00dcFE oran\u0131 %33,39 olarak belirlenmi\u015ftir. Bu durumda s\u00f6zle\u015fmesi Mart ay\u0131nda yenilenen kirac\u0131lar, mevcut kira bedelinin en fazla %33\u201939\u2019unu \u00f6demelidir. \u00d6rne\u011fin kira bedeli 25.000 TL olarak bir evin kiras\u0131na yap\u0131lacak maksimum zam, 8.347,5\u2019tir.<\/p>\n<p>Kirac\u0131 haklar\u0131 do\u011frultusunda ev sahiplerinin yasal s\u0131n\u0131r\u0131n \u00fczerinde zam talep etme hakk\u0131 yoktur. Bu noktada kirac\u0131lar\u0131n, s\u00f6zle\u015fme yenilenme d\u00f6nemi itibar\u0131yla \u00f6nceki kira bedelinin 12 ayl\u0131k T\u00dcFE ortalamas\u0131n\u0131 \u00f6demeleri yeterlidir.<\/p>\n<h2>Ev Sahibi Hangi Durumlarda Tahliye \u0130steyebilir?<\/h2>\n<p>Ev sahiplerinin kirac\u0131n\u0131n tahliyesini isteyebilece\u011fi durumlar, TBK 347., 350. 351. ve 353. maddelerinde a\u00e7\u0131klanm\u0131\u015ft\u0131r. Bu noktada Kanun, ev sahiplerinin kendi menfaati i\u00e7in kirac\u0131n\u0131 tahliye etmesini engelleyecek maddeler bar\u0131nd\u0131r\u0131r. TBK, keyfi uygulamalar\u0131n \u00f6n\u00fcne ge\u00e7mek ve kirac\u0131 haklar\u0131n\u0131 koruyacak bi\u00e7imde d\u00fczenlenmi\u015ftir. Ev sahibinin tahliye isteyebilece\u011fi ba\u015fl\u0131ca durumlar ise a\u015fa\u011f\u0131daki gibidir:<\/p>\n<ul>\n<li>10 y\u0131ll\u0131k s\u00f6zle\u015fme uzama s\u00fcresinin sona ermesi (En az \u00fc\u00e7 ay \u00f6nce haber vermek kayd\u0131yla)<\/li>\n<li>M\u00fclk sahibinin kendisi, e\u015fi ya da alt soyunun konut ihtiyac\u0131 do\u011fmas\u0131 (Bu durumda evin en az 3 y\u0131l boyunca yeniden kiraya verilmesi yasaklanm\u0131\u015ft\u0131r.)<\/li>\n<li>Kiralanan\u0131n yeniden in\u015fas\u0131 veya imar\u0131 amac\u0131yla esasl\u0131 onar\u0131m\u0131, geni\u015fletilmesi ya da de\u011fi\u015ftirilmesi gerekliyse (TBK md. 350)<\/li>\n<li>Kirac\u0131n\u0131n belli bir tarihte konutu bo\u015faltaca\u011f\u0131na dair yaz\u0131l\u0131 taahh\u00fctte bulunmas\u0131<\/li>\n<li>Bir s\u00f6zle\u015fme d\u00f6nemi boyunca iki hakl\u0131 ihtar al\u0131nmas\u0131<\/li>\n<\/ul>\n<p>TBK 352. maddeye g\u00f6re kirac\u0131n\u0131n veya e\u015finin ayn\u0131 lokasyonda bir evi varsa, tahliyesini istemek m\u00fcmk\u00fcnd\u00fcr.<\/p>\n<h2>Kira Tespit Davas\u0131 ve Be\u015f Y\u0131l Kural\u0131<\/h2>\n<p><a href=\"https:\/\/www.ilanlar.com\/emlak\/kiralik-konut\"><strong>Kiral\u0131k ev<\/strong><\/a> s\u00f6zle\u015fmeleri, en az 15 g\u00fcn \u00f6nceden haber verilmedi\u011fi m\u00fcddet\u00e7e her sene yenilenir. Fakat s\u00f6zle\u015fmenin \u00fczerinden 5 y\u0131l ge\u00e7tiyse yasal s\u00fcre\u00e7 de\u011fi\u015fkenlik g\u00f6sterir. Bu noktada ev sahipleri, T\u00dcFE \u00fcst s\u0131n\u0131r\u0131n\u0131n \u00fczerinde yeniden de\u011ferleme hakk\u0131na sahiptir. Ancak mahkeme, yeni kiray\u0131 belirlerken kirac\u0131n\u0131n eski olma durumunu hesaba katar. Yeniden de\u011ferleme s\u00fcrecinde rayi\u00e7 bedel \u00fczerinden hak ve nesafet indirimi uygulan\u0131r. B\u00f6ylece s\u00f6zle\u015fmesinin 5. y\u0131l\u0131n\u0131 dolduran kirac\u0131lar\u0131n haklar\u0131 kanunlar taraf\u0131ndan korunur.<\/p>\n<h2>Depozito Kurallar\u0131 ve Yasal \u0130ade \u015eartlar\u0131<\/h2>\n<p>Depozito, kirac\u0131dan kaynaklanan zararlar\u0131 tazmin etme maksad\u0131yla istenen bir g\u00fcvence bedelidir. S\u00f6z konusu bedel, yasalarla tamamen sabitlenmi\u015ftir. Kanun\u2019a g\u00f6re ev sahibinin isteyebilece\u011fi azami depozito tutar\u0131, mevcut kira bedelinin \u00fc\u00e7 kat\u0131d\u0131r. \u00dc\u00e7 ayl\u0131k s\u0131n\u0131r\u0131 a\u015fan depozito, T\u00fcrk Bor\u00e7lar Kanunu\u2019na g\u00f6re yasaklanm\u0131\u015ft\u0131r.<\/p>\n<p>Depozito bedelinin vadeli bir tasarruf hesab\u0131na do\u011frudan ve eksiksiz olarak yat\u0131r\u0131lmas\u0131 \u015fartt\u0131r. Bununla birlikte hesab\u0131n a\u00e7\u0131lmas\u0131 i\u00e7in hem kirac\u0131n\u0131n hem de m\u00fclk sahibinin onay\u0131 gerekir. Ayn\u0131 \u015fekilde hesaptan para \u00e7ekilmesi i\u00e7in iki taraf\u0131n da yaz\u0131l\u0131 onay vermesi gerekir. E\u011fer kirac\u0131 evi hasars\u0131z ve bor\u00e7suz olarak teslim ederse, depozito geri \u00f6denmelidir. Ev sahibi, kirac\u0131 m\u00fclk\u00fc bo\u015faltt\u0131ktan sonraki 3 ay i\u00e7inde dava a\u00e7mazsa, para otomatik olarak kirac\u0131ya aktar\u0131l\u0131r.
