Maliklerin haklar\u0131, 6306 say\u0131l\u0131 Afet Riski Alt\u0131ndaki Alanlar\u0131n D\u00f6n\u00fc\u015ft\u00fcr\u00fclmesi Hakk\u0131nda Kanun\u2019da a\u00e7\u0131k\u00e7a yer almaktad\u0131r. Bununla birlikte s\u00f6z konusu Kanun, kirac\u0131lar\u0131n hak gasp\u0131na u\u011framayaca\u011f\u0131 \u015fekilde optimize edilmi\u015ftir. Bu i\u00e7eri\u011fimizde kentsel d\u00f6n\u00fc\u015f\u00fcm s\u00fcrecinde hak sahipli\u011fine dair s\u0131k\u00e7a merak edilen detaylara yer verece\u011fiz. Ev sahiplerinin haklar\u0131 ile birlikte ev kentsel d\u00f6n\u00fc\u015f\u00fcme girerse kirac\u0131 ne yapar sorusunu da yan\u0131tlayaca\u011f\u0131z.<\/p>\n<h2>Riskli Yap\u0131 Karar\u0131n\u0131n Kesinle\u015fmesi ve S\u00fcrecin Ba\u015flamas\u0131<\/h2>\n<p>Kentsel d\u00f6n\u00fc\u015f\u00fcm s\u00fcreci, yasal dayana\u011f\u0131n\u0131 6306 say\u0131l\u0131 Kanun\u2019dan al\u0131r. Dolay\u0131s\u0131yla riskli yap\u0131 s\u00fcreci ve taraflar\u0131n haklar\u0131, ilgili kanunda detayland\u0131r\u0131lm\u0131\u015ft\u0131r. Son olarak SPK lisansl\u0131 bir gayrimenkul de\u011ferleme \u015firketi, binan\u0131n g\u00fcncel de\u011ferini hesaplar.<\/p>\n<h2>M\u00fclk Sahiplerinin Yasal Haklar\u0131 ve M\u00fcteahhit Anla\u015fmalar\u0131<\/h2>\n<p>Kentsel d\u00f6n\u00fc\u015f\u00fcm s\u00fcrecinde eski bina y\u0131k\u0131lsa bile kat malikleri m\u00fclkiyet haklar\u0131n\u0131 kaybetmez. \u00d6te yandan s\u00fcrecin ba\u015flamas\u0131 i\u00e7in eskiden \u00fc\u00e7te iki kural\u0131 gerekliydi. G\u00fcncel yasaya g\u00f6re ise arsa pay\u0131n\u0131n salt \u00e7o\u011funlu\u011fu, d\u00f6n\u00fc\u015f\u00fcm karar\u0131 i\u00e7in yeterlidir. B\u00f6ylece kentsel d\u00f6n\u00fc\u015f\u00fcmde \u00fc\u00e7te iki \u00e7o\u011funluk sa\u011flanamazsa ne olur endi\u015fesi sona ermi\u015ftir. M\u00fclk sahiplerinin karar\u0131 sonras\u0131nda ise s\u00fcre\u00e7, bir sonraki a\u015famaya ge\u00e7er. Sonraki a\u015famada m\u00fcteahhit se\u00e7imi gelir. Yeni yasan\u0131n en \u00f6nemli avantaj\u0131 ise s\u00fcreci yava\u015flatan b\u00fcrokratik engelleri sonra erdirmesidir. B\u00f6ylece hak sahipleri, vakit kayb\u0131 ya\u015famadan yeni ve g\u00fcvenli evlerine kavu\u015fma yoluna girer.<\/p>\n<p>M\u00fcteahhit firmayla anla\u015f\u0131rken arsa pay\u0131 kar\u015f\u0131l\u0131\u011f\u0131 in\u015faat s\u00f6zle\u015fmesi imzalanmas\u0131 zorunlulu\u011fu vard\u0131r. Bu noktada mal sahipleri, kentsel d\u00f6n\u00fc\u015f\u00fcmde m\u00fcteahhit ile s\u00f6zle\u015fme imzalarken baz\u0131 hususlara dikkat etmelidir. Bilhassa \u015ferefiye bedeli hesaplama i\u015flemlerinin adil olmas\u0131 gerekir. E\u011fer anla\u015fmaya kat\u0131lmayan likler varsa, ilgili ki\u015filere noter arac\u0131l\u0131\u011f\u0131yla resmi tebligat g\u00f6ndermek gerekir. Kirac\u0131lar\u0131n tahliyesi i\u00e7in en az altm\u0131\u015f g\u00fcnl\u00fck s\u00fcre ge\u00e7mesi gerekir. Yard\u0131mdan yararlanmak isteyen kirac\u0131lar\u0131n gerekli belgelerle Bakanl\u0131\u011fa ba\u015fvuruda bulunmas\u0131 \u015fartt\u0131r. Kentsel d\u00f6n\u00fc\u015f\u00fcm s\u00fcrecinde ta\u015f\u0131nma yard\u0131m\u0131 almak isteyen kirac\u0131lar\u0131n ibraz etmesi gereken belgeler, \u015fu \u015fekildedir:<\/p>\n<ul>\n<li>Kimlik kart\u0131n\u0131n fotokopisi<\/li>\n<li>Belediye ya da ilgili m\u00fcd\u00fcrl\u00fck taraf\u0131ndan onaylanan riskli yap\u0131 teyit raporu<\/li>\n<li>Hem eski hem de yeni adresi g\u00f6steren rapor<\/li>\n<li>Tahliye \u00f6ncesindeki 90 g\u00fcn i\u00e7erisinde kirac\u0131 ad\u0131na kay\u0131tlanan bir fatura<\/li>\n<li>Banka hesab\u0131 hesap c\u00fczdan\u0131 fotokopisi<\/li>\n<li>Ba\u015fvuru dilek\u00e7esi<\/li>\n<\/ul>\n<p>Kirac\u0131lar, e-Devlet kanal\u0131 \u00fczerinden ya da \u00c7evre, \u015eehircilik ve \u0130klim De\u011fi\u015fikli\u011fi Bakanl\u0131\u011f\u0131 m\u00fcd\u00fcrl\u00fc\u011f\u00fcne ba\u015fvuruda bulunarak yard\u0131mdan yararlanabilir.<\/p>\n<h2>Kira Yard\u0131m\u0131 ve Ta\u015f\u0131nma Deste\u011fi \u015eartlar\u0131 Nelerdir?<\/h2>\n<p>Devlet, kentsel d\u00f6n\u00fc\u015f\u00fcm s\u00fcrecinin sorunsuz ve ma\u011fduriyete sebep olmadan ilerlemesi a\u00e7\u0131s\u0131ndan \u00e7e\u015fitli destekler sunar. Bu noktada hem ev sahipleri hem de kirac\u0131lar, devletin verdi\u011fi yard\u0131mlardan yararlan\u0131r. \u201cKentsel d\u00f6n\u00fc\u015f\u00fcm kira yard\u0131m\u0131 \u015fartlar\u0131 nedir?\u201d sorusu ise hem malikler hem de kirac\u0131lar taraf\u0131ndan s\u0131k\u00e7a sorulur.
