Bu ba\u011flamda Bor\u00e7lar Kanunu\u2019nun 299 maddesinden ba\u015flayarak 378. maddesine de\u011fin, kira s\u00f6zle\u015fmelerinde taraflar\u0131n hakk\u0131n\u0131 koruyan hususlar d\u00fczenlenmi\u015ftir. Bununla birlikte Bor\u00e7lar Kanunu\u2019na g\u00f6re \u00fc\u00e7 \u00e7e\u015fit kira s\u00f6zle\u015fmesi vard\u0131r.<\/p>\n<p>Gayrimenkul s\u00f6zle\u015fmeleri; mesken, i\u015f yeri, arsa ve arazi gibi ta\u015f\u0131nmaz mallara dair haklar\u0131 tan\u0131mlar. \u00d6te yandan s\u00f6z konusu yaz\u0131l\u0131 anla\u015fma, ta\u015f\u0131nmaz\u0131 kiralayan ki\u015fi ya da kurumlar\u0131n hakk\u0131n\u0131 korumak i\u00e7in m\u00fchimdir. Daha da \u00f6nemlisi m\u00fclk sahibinin sahip oldu\u011fu ta\u015f\u0131n\u0131r mallara, gayrimenkullere ve \u00fcr\u00fcnlere dair haklar\u0131n\u0131 da yasal \u00e7er\u00e7evede korur.<\/p>\n<h2>Kira S\u00f6zle\u015fmesinin Hukuki Ge\u00e7erlili\u011fi \u0130\u00e7in Hangi \u015eartlar Gerekir?<\/h2>\n<p>Taraflar aras\u0131nda bir anla\u015fma oldu\u011fu, ta\u015f\u0131n\u0131r ya da ta\u015f\u0131nmazlar\u0131n kullan\u0131ma dair bilgileri i\u00e7ermesi ve kira bedelinin belirtilmesi, s\u00f6zle\u015fmenin hukuki ge\u00e7erlili\u011fi i\u00e7in yeterlidir. Bunun yan\u0131 s\u0131ra e\u015fyalar\u0131n, gayrimenkullerin ya da ta\u015f\u0131n\u0131r mallar\u0131n kullan\u0131m\u0131na dair yap\u0131lan s\u00f6zle\u015fme, yaz\u0131l\u0131 ya da s\u00f6zl\u00fc olabilir. Kanuna g\u00f6re s\u00f6z konusu s\u00f6zle\u015fmelerin yaz\u0131l\u0131 ya da s\u00f6zl\u00fc olmas\u0131n\u0131n bir fark\u0131 yoktur. Fakat s\u00f6zl\u00fc olarak yap\u0131lan anla\u015fmalarda taraflar\u0131n ilgili hususa dair ispatlama y\u00fck\u00fc mevcuttur. Bundan dolay\u0131 hem <strong>kira veren<\/strong> hem de mal sahibinin, haklar\u0131na dair yaz\u0131l\u0131 bir s\u00f6zle\u015fme yapmalar\u0131 \u00f6nerilmektedir.<\/p>\n<p>Hukuken ge\u00e7erli bir kira s\u00f6zle\u015fmesi a\u015fa\u011f\u0131dakileri i\u00e7erir:<\/p>\n<ul>\n<li>Mal sahibi ve kirac\u0131ya ait kimlik bilgileri, kontratta yer almal\u0131d\u0131r. Bunun yan\u0131 s\u0131ra taraflar\u0131n adres ve ileti\u015fim bilgileri de ilerleyen zamanda olu\u015facak problemlerde hukuki haklar\u0131n kullan\u0131m\u0131 ad\u0131na \u00f6nem arz eder.<\/li>\n<li>Kiralanan ta\u015f\u0131nmazlar\u0131n ya da di\u011fer mallar\u0131n genel \u00f6zellikleri ise s\u00f6zle\u015fmenin ge\u00e7erlili\u011fi ad\u0131na \u00f6nemli di\u011fer bir noktad\u0131r.<\/li>\n<li>Kirac\u0131n\u0131n, s\u00f6zle\u015fmede ge\u00e7en gayrimenkul ya da e\u015fya i\u00e7in ne kadar \u00f6deme yapaca\u011f\u0131 ve kira periyotlar\u0131 da yazmal\u0131d\u0131r.<\/li>\n<li>Kontrat\u0131n ge\u00e7erlilik s\u00fcresi ve ba\u015flang\u0131\u00e7 tarihi ise ge\u00e7erlilik i\u00e7in m\u00fchimdir.<\/li>\n<\/ul>\n<p>Bunlar\u0131n yan\u0131 s\u0131ra hem kirac\u0131n\u0131n hem de mal sahibinin sorumluluklar\u0131 da s\u00f6zle\u015fmede d\u00fczenlenmelidir.<\/p>\n<h2>Kira S\u00f6zle\u015fmesinde Kirac\u0131 ve Kiraya Verenin Haklar\u0131 Nas\u0131l Belirlenir?<\/h2>\n<p>6098 say\u0131l\u0131 Bor\u00e7lar Kanunu hem kirac\u0131n\u0131n hem de kiraya verenin haklar\u0131n\u0131 koruma alt\u0131na alacak maddeler i\u00e7erir. Fakat s\u00f6z konusu haklar\u0131 yaz\u0131l\u0131 bir kontratta belirtmek, her iki taraf\u0131n da y\u00fck\u00fcml\u00fcl\u00fcklerini bilmesi ad\u0131na \u00f6nem arz eder. Bunun yan\u0131 s\u0131ra meydana gelecek bir anla\u015fmazl\u0131k durumunda kirac\u0131n\u0131n ve mal sahibinin bunu ispat etmesi ad\u0131na m\u00fchimdir. Bu \u00e7er\u00e7evede bir s\u00f6zle\u015fmede \u015funlar muhakkak bulunmal\u0131d\u0131r:<\/p>\n<ul>\n<li><strong>M\u00fclk sahibi <\/strong>i\u00e7in; kiray\u0131 zaman\u0131nda alma, mal\u0131n \u00f6zenli kullan\u0131m\u0131, k\u0131smi de\u011fi\u015fiklikler, ta\u015f\u0131n\u0131rlar \u00fczerinde hapis ve kirac\u0131n\u0131n tahliyesini isteme haklar\u0131<\/li>\n<li>Kirac\u0131 i\u00e7in; amaca uygun olarak mal\u0131 teslim alma, kullan\u0131ma dair sorunlar\u0131n giderilmesi, zarar tazmini, yan giderleri talep etme ve s\u00f6zle\u015fmeyi feshetme haklar\u0131<\/li>\n<\/ul>\n<p>Bunlar\u0131n yan\u0131 s\u0131ra taraflar\u0131n haklar\u0131 ve sorumluluklar\u0131na dair d\u00fczenlemeler, T\u00fcrk Bor\u00e7lar Kanunu\u2019nda belirtildi\u011fi \u00fczere s\u00f6zle\u015fmede bulunur. Ek olarak s\u00f6zle\u015fme haz\u0131rlarken hukuki destek almak ya da bir<strong> kira s\u00f6zle\u015fme \u00f6rne\u011fi <\/strong>\u00fczerinden hareket etmek m\u00fcmk\u00fcnd\u00fcr.<\/p>\n<h2>Kira Bedeli ve \u00d6deme \u015eartlar\u0131 Nas\u0131l D\u00fczenlenmelidir?<\/h2>\n<p>S\u00f6zle\u015fmede kira bedelini ve buna dair \u00f6deme \u015fartlar\u0131n\u0131 belirtmek, kirac\u0131n\u0131n asl\u00ee edimini yaz\u0131l\u0131 olarak kaydetmek i\u00e7in kritik bir noktad\u0131r. Bu noktada kirac\u0131, s\u00f6zle\u015fmede yer ald\u0131\u011f\u0131 \u015fekilde kiray\u0131 \u00f6demek zorundad\u0131r. Bununla birlikte s\u00f6z konusu bedel, muhakkak hem rakamla hem de yaz\u0131yla yer almal\u0131d\u0131r. Ayr\u0131ca kirac\u0131n\u0131n, \u00f6demeleri yapmak i\u00e7in kullanaca\u011f\u0131 y\u00f6ntem de kontratta yer almal\u0131d\u0131r.<\/p>\n<h2>Kira S\u00fcresi ve Uzatma \u015eartlar\u0131 S\u00f6zle\u015fmede Nas\u0131l Belirlenir?<\/h2>\n<p>S\u00f6zle\u015fmede aksi bir madde bulunmad\u0131\u011f\u0131 m\u00fcddet\u00e7e kira s\u00f6zle\u015fmesi genel olarak bir senelik olarak yap\u0131l\u0131r. Bunun yan\u0131 s\u0131ra yaz\u0131l\u0131 kontratta kira s\u00fcresine dair ek maddeler eklemek m\u00fcmk\u00fcnd\u00fcr. Bununla birlikte <strong>noter<\/strong> imzal\u0131 tahliye taahh\u00fctnamesi bulunmad\u0131\u011f\u0131 m\u00fcddet\u00e7e, kirac\u0131 s\u00f6z konusu mal \u00fczerindeki haklar\u0131n\u0131 kullanmaya devam eder. \u00d6te yandan gayrimenkuller i\u00e7in 10 y\u0131ll\u0131k s\u00fcre sonunda ev sahiplerinin kirac\u0131y\u0131 tahliye hakk\u0131 mevcuttur.<\/p>\n<h2>Kira S\u00f6zle\u015fmesinde Depozito ve G\u00fcvence Bedeli Hangi Durumlarda Al\u0131nmal\u0131d\u0131r?<\/h2>\n<p>Depozito, mal sahibinin haklar\u0131n\u0131 koruyan ve kirac\u0131dan kaynaklanan zararlar\u0131n temini noktas\u0131nda \u00f6nemli olan g\u00fcvence bedelidir. Mal sahipleri, kiralanan e\u015fya ya da gayrimenkulde ortaya \u00e7\u0131kacak zararlar i\u00e7in depozito talep etme hakk\u0131na sahiptir. Bununla birlikte hem depozito miktar\u0131 hem de bunun iadesine dair ayr\u0131nt\u0131lar s\u00f6zle\u015fmede muhakkak yazmal\u0131d\u0131r. \u00d6te yandan mevcut kanun maddesine g\u00f6re s\u00f6z konusu bedel, \u00fc\u00e7 ayl\u0131k kira de\u011ferini a\u015famaz. Bu ba\u011flamda g\u00fcvence bedeli, para olarak ya da k\u0131ymetli evrak cinsinden al\u0131nabilir.<\/p>\n<h2>Kira S\u00f6zle\u015fmesinde Evin Durumu ve Onar\u0131m Sorumluluklar\u0131 Nas\u0131l Belirtilmelidir?<\/h2>\n<p>Bir kira kontrat\u0131 yaparken evin mevcut durumu ve bunun korunmas\u0131na dair madde muhakkak eklenmelidir. Bununla birlikte ev sahibinin belirli durumlarda evde bak\u0131m ve tadilat yapma hakk\u0131 vard\u0131r. Ek olarak kirac\u0131, evi kullan\u0131labilir olarak teslim almal\u0131 ve buna y\u00f6nelik problem yaratan durumlarda ev sahibinden kusurlar\u0131 d\u00fczeltmesini talep etmelidir. Ayr\u0131ca kiraya verenin, kirac\u0131 kaynakl\u0131 zararlar\u0131 tazmin edebilece\u011fine dair madde de kontrat i\u00e7eri\u011finde yer almal\u0131d\u0131r.<\/p>\n<h2>Kira S\u00f6zle\u015fmesinde Erken Fesih \u015eartlar\u0131 Nas\u0131l D\u00fczenlenir?<\/h2>\n<p>Hem kirac\u0131 hem de kiraya veren, g\u00fcven ili\u015fkisinin zarar g\u00f6rmesi halinde s\u00f6zle\u015fmenin feshini talep etme hakk\u0131na sahiptir. Fakat s\u00f6z konusu<strong> s\u00f6zle\u015fme <\/strong>feshi \u015fartlar\u0131, muhakkak kanuna uygun \u015fekilde d\u00fczenlenmelidir. Bu ba\u011flamda kontrat\u0131n iptaline ili\u015fkin taraflar\u0131n haklar\u0131 a\u015fa\u011f\u0131da yer almaktad\u0131r:<\/p>\n<ul>\n<li>Yaz\u0131l\u0131 bir feshi bildiriminin belirlenen s\u00fcreler i\u00e7inde taraflara ula\u015fmas\u0131 elzemdir.<\/li>\n<li>Belirli bir s\u00fcreli\u011fine d\u00fczenlenen kontratta kirac\u0131, s\u00f6zle\u015fme bitiminden 15 g\u00fcn \u00f6nce feshetme hakk\u0131na sahiptir.<\/li>\n<li>Kiraya veren ise 10 y\u0131ll\u0131k uzatma s\u00fcresinin dolmas\u0131na 3 ay kala yaz\u0131l\u0131 olarak bildirimde bulunmal\u0131d\u0131r.<\/li>\n<\/ul>\n<p>Bunlar\u0131n yan\u0131 s\u0131ra ilgili Kanun\u2019un 331. maddesine g\u00f6re ola\u011fan\u00fcst\u00fc hallerde taraflar\u0131n s\u00f6zle\u015fme bitiminden \u00f6nce fesih hakk\u0131 mevcuttur.<\/p>\n<h2>Kira S\u00f6zle\u015fmesinde Evin Kullan\u0131m Amac\u0131 Nas\u0131l A\u00e7\u0131klanmal\u0131d\u0131r?<\/h2>\n<p>Mevcut yasaya g\u00f6re, kirac\u0131 bir s\u00f6zle\u015fme do\u011frultusunda belirli s\u00fcreli\u011fine kullan\u0131m hakk\u0131na sahip oldu\u011fu mal\u0131 \u00f6zg\u00fcrce kullanma hakk\u0131na sahiptir. Lakin bu durumda kirac\u0131n\u0131n evi nas\u0131l kullanaca\u011f\u0131na dair hususlar s\u00f6zle\u015fmede yer almal\u0131d\u0131r. \u00d6rne\u011fin kirac\u0131n\u0131n evi yaln\u0131zca kendisinin kullanaca\u011f\u0131 ve ba\u015fkalar\u0131na kiraya vermeyece\u011fi a\u00e7\u0131k\u00e7a yazmal\u0131d\u0131r.
